The Governor’s Executive Order on commercial the eviction moratorium, expired on Thursday, September 30, 2021. Thus, ended the protections that prevented commercial evictions of small businesses and non-profit organizations for nonpayment of rent. Back rent may be due in full depending on the payment plan or other agreement negotiated between the tenant and landlord.

San Francisco’s Office of Economic and Workforce Development has a Commercial Eviction Moratorium webpage for resources, FAQs, and information about legal assistance, some of which are SF-based, and some of which are applicable to all jurisdictions
Through grants from the City of Oakland, the Lawyers’ Committee for Civil Rights of the San Francisco Bay Area (LCCR) continues to provide commercial lease negotiation assistance to small business owners.

LCCR will host both in-person and virtual “Know Your Rights for Commercial Tenants” seminars in October to assist owners who face eviction once the moratorium ends. Both sessions will cover the eviction process and legal protections available. Once confirmed, these seminars will be added to the City’s webinars web page.
